– 2026年劉曉波逝世9週年中國憲政民主討論會上的發言

在作家劉曉波逝世九週年之際,於首屆「劉曉波人權獎」頒獎典禮上,我有幸以英語發表了一篇關於他於2008年發表的《零八憲章》的憲政反思。

關於憲法原則的論述可追溯至古希臘(亞里士多德)。這項論述歷經了轉變與發展,也經歷過衰落的時期。

那種常被稱為實證主義的法律觀——將成文法單純視為政府的工具——在教條上是錯誤的。憲法條文與憲法原則之間存在著張力關係。這些原則對於公法結構的轉型——從國家公法轉變為體現於1949年《聯合國憲章》的國際法——具有決定性作用,並使憲法成為一個以原則為導向的實質性價值體系。就中國而言,劉曉波在《零八憲章》中,借鑒了全球關於憲法原則的論述,首次重新闡述了這些原則。早在1916年,即德意志帝國成立之前,中國便已出現向共和制轉變的趨勢。在1949年共產黨贏得內戰後、1976年毛澤東獨裁統治結束後,以及1989年將公民權與人權納入憲法之際,中國相繼掀起了多波憲法改革浪潮。我必須強調,《零八憲章》對全球憲法改革辯論作出了重大貢獻。

2008年,劉曉波提出了19項改革倡議,旨在克服極權的一黨專政體制。

1. 成立制憲會議以起草新憲法。

2. 「政府各部門」的相互制衡與職權分離。

3. 透過自由選舉產生的立法機關。

4. 獨立的司法機關。

5. 無論黨派歸屬,均可自由遴選所有公職人員。

6. 所有公民均可自由透過法律途徑,就侵犯人權行為提出申訴。(這在德國幾乎不存在。)

7. 所有公職人員均由自由選舉產生(在德國,如同帝制時期的中國,人們仍需通過考試才能擔任公職,例如通過法律助理考試後)。

8. 農村與城市人口在社會福利享有方面不分彼此(戶口制度;此制度目前正被廢除)。

9. 集會自由。任何群體組建組織無需取得許可。此規定至今仍適用。

10. 集會自由。

11. 言論自由與新聞自由。

12. 宗教自由

13. 教育自由,特別是免受政治灌輸的自由。

14. 財產權的保障與競爭自由。這些權利現已落實。

15. 公平的稅制,不給予黨員特權。

16. 社會保障體系,確保民眾能公平、平等地獲得教育、醫療保險、退休金及失業救濟金。

17. 環境保護。

18. 建立一個針對香港、澳門及台灣設有明確憲法規定的聯邦體制,此舉有望促成一個由中國境內各民族及文化群體(藏人、南蒙古人、維吾爾人等)所組成的繁榮聯邦共和國。

19. 針對1949年至2008年間所採取的一切有害措施,提供真正的賠償。

這19項改革提案僅在制憲會議恪守《零八憲章》的六項原則時方可實施;作為總體原則,這些原則必須優先於個別改革提案。

這六項原則是劉曉波的傑作。憑藉這些原則,他豐富了關於憲法的討論:

1. 人的自由,體現於言論自由、新聞自由、集會自由、結社自由、居住自由及示威自由。

2. 人權是每個人與生俱來的權利,構成了其尊嚴與自由的本質。

3. 所有人的平等,不論其社會地位、職業、性別、族裔、膚色、宗教或政治見解。法律面前人人平等,以及社會、經濟、文化、公民與政治上的平等,都必須得到保障。

4. 共和原則(res publica 對比 res privata)必須得到保障,具體而言,應確保政府機構符合中國「天下萬物公平平等」的原則(Tian Xia)。來自不同文化與信仰的各類群體及社會團體,必須能夠進行民主自治。

5. 民主。其基礎在於政府權力須依循由自由選舉所決定的人民意志。每位公職人員均經選舉產生,任期有限,且僅能透過定期舉行的選舉獲任。多數原則受少數群體權利所制約。簡言之,源自民主的政府形式,乃基於「民有、民治、民享」這三項原則。(亞伯拉罕·林肯《葛底斯堡演說》: 「民有、民治、民享的政府。」)

6. 憲法國家。其透過一套法律條文體系而建立,該體系旨在保障上述原則(第1至6項),以保護公民權利、限制制度權力,並建立公共行政機構。

依法治國,若僅被工具性地理解為書面權力手段,則遠遠不及受這些原則約束的法治。《零八憲章》將這19項改革提案引入憲法辯論,藉此使中國的憲法論述參與全球憲法論述。這6項原則與19項改革提案,可以說都是不言自明的。然而,作為結構性因素——也就是在幕後發揮作用的因素——必須反覆將其提請公眾關注。

這19項改革提案在18年前對中國而言具有直接相關性。如今,其他問題則更為迫切:台灣獨立問題;整個中國影響範圍內的聯邦結構;環境保護;中國與美國、日本及歐盟的國際關係;以及非洲和南美國家對中國的準殖民依附問題。

今天,我想僅提及四項具體的專制與一黨專政的憲政缺陷,根據劉曉波——連同其他作者——在《零八憲章》中闡明的原則,這些缺陷值得我們在這個紀念日,以及首屆「劉曉波人權獎」頒獎之日予以關注:

1. 公民社會信用體系,在此體系下,民眾根據數位化決定的績效分數,享有不同程度的公共服務。這公然違反了人人平等的原則。

2. 將中國共產黨總書記的任期延長至終身。這是對個人權力主張的一種混合式擴張。

3. 根據中國缺乏創見的法律體系,在全球範圍內起訴僅在中國境內被視為犯罪的行為。這侵犯了對其他主權國家的尊重。

4. 台北當局曾勇敢地走上一條從獨裁體制邁向民主憲政國家的道路。然而,1971年中國在未採納《聯合國憲章》條款的情況下,便接任聯合國安全理事會席位,因此其國際社會成員資格始終僅是象徵性的。此舉構成了對國際社會憲政秩序的進一步侵犯。

這四項攻擊,代表著針對「人類對話」——即關於何為適合全人類的良好憲政之議題——所採取的行徑。這些攻擊顯示,我們今日所處的時代——表面上——已然成為一個缺乏道德與理性的時代。

倘若台灣被併入中國的一黨專政國家,這將意味著對劉曉波透過《零八憲章》所大力支持的運動,再次予以背棄。

Charter 08 represents a significant contribution to the global debate on constitutional reform

  • Speech at the Ninth Anniversary of Liu Xiaobo’s Passing

On the ninth anniversary of author Liu Xiaobo’s death, during the inaugural award ceremony for the “Liu Xiaobo Human Rights Prize,” I had the honor of presenting constitutional reflections on “Charter 08,” which he published in 2008.

The discourse on the principles of a constitution has its origins in ancient Greece (Aristotle). This discourse has undergone shifts and developments, as well as periods of decline.

An understanding of law—often described as positivist—that views written law simply as a tool of government is dogmatically incorrect. Constitutional provisions stand in a relationship of tension with constitutional principles. These principles are decisive for the structural transformation of public law—from national public law to international law as embodied in the 1949 UN Charter—and make constitutional law a substantive system of values oriented toward principles. In the case of China, Liu Xiaobo first reformulated these principles in Charter 08, drawing on the global discourse on constitutional principles. As early as 1916, before the German Empire, there was already a shift toward a republic in China. Waves of constitutional reform occurred after the Communist Party’s victory in the civil war in 1949, after the end of Mao Zedong’s dictatorship following 1976, and in 1989 through the incorporation of civil and human rights into the constitution. I would like to emphasize that Charter 08 represents a significant contribution to the global debate on constitutional reform.

In 2008, Liu Xiaobo proposed 19 reform initiatives to overcome the totalitarian one-party regime.

1. A constituent assembly to draft a new constitution.

2. An intertwining and separation of the “branches of government.”

3. A legislature elected through free elections.

4. An independent judiciary.

5. Free selection of all public officials regardless of party affiliation.

6. A free legal recourse for all citizens to file complaints regarding human rights violations. (This is virtually nonexistent in Germany.)

7. Free election of all public officials (in Germany, as in imperial China, one still gains access to public office through examinations, for example, after passing the legal assessor exam).

8. No distinction between rural and urban populations regarding access to social benefits (the hu-kou system; this is currently being abolished).

9. Freedom of assembly. No requirement to obtain permission for any group of people to form an organization. This still applies today.

10. Freedom of assembly.

11. Freedom of speech and freedom of the press.

12. Freedom of religion

13. Freedom of education, particularly freedom from political indoctrination.

14. Protection of property rights and freedom of competition. These have since been implemented.

15. A fair tax system without privileges for party members.

16. A social security system that guarantees fair and equal access to education, health insurance, retirement benefits, and unemployment benefits.

17. Environmental protection.

18. A federal system with distinct constitutional provisions for Hong Kong, Macau, and Taiwan, which could lead to a thriving federal republic comprising the various ethnic and cultural communities (Zangren (Tibetans), Southern Mongols, Uyghurs, etc., etc.) in China.

19. Genuine reparations for all harmful measures taken between 1949 and 2008.

These 19 reform proposals should only be implemented if the Constituent Assembly adheres to the six principles of Charter 08, which, as overarching principles, must be given priority over the individual reform proposals.

The six principles are a stroke of genius by Liu Xiaobo. With them, he has enriched the discussion on the constitution:

1. Human freedom through freedom of speech, a free press, freedom of assembly, freedom of association, freedom of residence, and freedom of demonstration.

2. Human rights are inherent to every person by birth and constitute the essence of their dignity and freedom.

3. The equality of all people regardless of social status, occupation, gender, ethnicity, skin color, religion, or political opinion. Equality before the law, as well as social, economic, cultural, civil, and political equality, must be guaranteed.

4. The principle of the republic (res publica versus res privata) must be guaranteed, specifically by ensuring that the institutions of government conform to the Chinese principle of “fair and equal treatment of all things under heaven” (Tian Xia). Democratic self-government by various groups and social associations of people from different cultures and faiths must be possible.

5. Democracy. It begins with the dependence of governmental power on the will of the people, as determined by free elections. Every public official is elected for a limited term and may be appointed to office only through periodically recurring elections. The majority principle is limited by minority rights. In short, the form of government that emerges from democracy arises from the threefold principle of government of the people, by the people, and for the people. (Gettysburg Address, Abraham Lincoln: “Government of the people, by the people, and for the people.”)

6. The constitutional state. It is established through a system of legal provisions that guarantee these principles (1 through 6) for the protection of civil rights, the limitation of institutional power, and the provision of public administrative institutions.

Rule by Law, understood instrumentally as a written means of power, falls far short of the Rule of Law, which is bound by these principles. Charter 08 introduces the 19 reform proposals into the constitutional debate, through which the Chinese constitutional discourse participates in the global constitutional discourse. All 6 principles and all 19 reform proposals are, so to speak, self-evident. However, as structural factors—that is, factors operating in the background—they must be repeatedly brought to the public’s attention.

The 19 reform proposals were of immediate relevance to China 18 years ago. Today, other problems are more pressing: the question of Taiwan’s independence; the federal structure of the entire Chinese sphere of influence; environmental protection; China’s international relations with the U.S., Japan, and the EU; and the issues of paracolonial dependencies of African and South American countries on China.

Today I would like to mention just four specific autocratic and monocratic constitutional deficits which, in accordance with the principles Liu Xiaobo—along with other authors—incorporated into Charter 08, deserve our attention on this day of remembrance and on the day of the first presentation of the Liu Xiaobo Human Rights Prize:

1. The citizen social credit system, under which people have varying access to public services based on digitally determined performance points. This blatantly violates the principle of the equality of all people.

2. The extension of the CCP General Secretary’s term of office to last for life. This is a hybrid expansion of a single person’s claim to power.

3. The prosecution of criminal acts worldwide that are considered criminal only in China under its uninspired legal system. This violates respect for other sovereign states.

4. In Taipei, the path from dictatorship to a democratic constitutional state was courageously pursued. The assumption of a seat on the UN Security Council in 1971, without adopting the provisions of the UN Charter, therefore remained a mere token membership in the international community. It constitutes a further attack on the constitution of the international community.

These four attacks represent a practice directed against “humanity’s dialogue” on the questions of a good constitution for humanity. The attacks show that we are living today—ostensibly—in an age without morality and without reason.

Should Taiwan be incorporated into the Chinese one-party state, this would constitute yet another renunciation of the movement that Liu Xiaobo so significantly supported through Charter 08.

    vortragen.

    Der Diskurs um die Prinzipien einer Verfassung ist griechischen Ursprungs (Aristoteles). Es gibt in diesem Diskurs Wendungen und Entwicklungen, sowie Verfallsphasen.

    Ein oft positivistisch genanntes Rechtsverständnis, dass geschriebenes Recht schlicht als Regierungsinstrument (tool) versteht, ist dogmatisch nicht richtig. Verfassungsvorschriften stehen in einem Spannungsverhältnis zu Verfassungsprinzipien. Diese Prinzipien sind für den Strukturwandel des öffentlichen Rechts von nationalem öffentlichen Recht mit den Völkerrecht UN-Chater 1949) entscheidend und  machen das Verfassungsrecht zu einer an  Prinzipien orientierten substanziellen Werteordnung. Im Fall Chinas hat Liu Xiaobo diese Prinzipien erst  in Anlehnung an den Menschheitsdiskurs über  Verfassungsprinzipien neu in der Charta 08 formuliert. 1916 gab es bereits eine Hinwendung zur Republik in China vor dem Deutschen Kaiserreich. Schübe verfasungsrechtlicher Neuerung gab es nach dem Sieg der Kommunistischen Partei im Bürgerkrieg 1949, nach dem Ende der Diktatur Mao Zedongs nach 1976 und 1989 durch die Aufnahme der Bürger und Menschenrechte in die Verfassung. Die Tatsache, dass die Chater 08 eine bedeutender Eingriff in die weltweit Verfassungsreformdiskussion darstellt will ich hervorheben.

    19 Reformprojekte schlägt 2008 Lio Xiaobo zur Überwindung des totalitären Einparteienregimes vor.

    1. Eine verfassungsgebende Versammlung für eine Neue Verfassung, 2.Eine Verschränkung und Teilung der „branches of government“, 3. eine Legislative, die aus freien Wahlen hervorgeht, 4.eine unabhängige Justiz, 5.eine freie Auswahl aller Amtsträger ohne Rücksicht auf Parteizugehörigkeit, 6.ein freier Klageweg wegen Verletzung der Menschenrechte für alle Bürger (Das gibt es kaum in Deutschland), 7. freie Wahl aller Amtsträger (in Deutschland kommt man, wie im kaiserlichen China noch durch Examina in öffentliche Ämter zum Beispiel nach dem juristischen Assesorexamen), 8. keine Unterscheidung zwischen Land- und Stadtbevölkerung beim Zugang zu Sozialleistungen (Huo-ku System. Das wird gerade abgeschafft.), 9.Versammlungsfreiheit. Keine Genehmigungspflicht für jegliche Zusammenschlüsse von Menschen zu Organisationen.Das gilt heute noch. 10. Versammungsfreiheit, 11. Meinungsfreiheit und Pressefreiheit, 12. Religionsfreiheit, 13. Bildungsfreiheit insbesondere Freiheit von politischer Indoktrination. 14. Schutz des Eigentums und Wettbewerbsfreiheit. Das ist inzwischen eingeführt. 15. Ein gerechtes Steuersystem ohne Privilegien für Parteimitglieder.16. Ein Sozialversicherungs- system, das freien Zugang zu Bildung, Gesundheitsversicherung, Altersversorgung und Arbeitslosigkeit fair und gleich garantiert. 17.Umweltschutz, 18. Ein Föderales System mit abweichenden verfassungsrechtlichen Regelungen für Hongkong, Macao, Taiwan, die zu einer blühenden  Bundesrepublik der verschiedenen ethnischen und kulturellen Gemeinschaft (Tibet, Innere Mongolei, Land der Uiguren etc. etc.) in China führen könnte.

    Diese 19 Reformprojekte sollen nur durchgesetzt werden, wenn sich die Verfasungsgebendeversammlung an die 6 Prinzipien hält, die als höherrangige Prinzipien in einer Spannung zu den einzelnen Reformprojekten Beachtung finden müssen.

    Die 6 Prinzipien sind  ein genialer Wurf Liu Xioabos. Er hat damit die Diskussion über Verfassung gereichert.

    1. Freiheit der Menschen durch Redefreiheit, eine freie Presse, Versammlungsfreiheit, Vereinigungsfreiheit, Niederlassungsfreiheit, Demonstrationsfreiheit.

    2. Die Menschenrechte stehen jeden Menschen durch Geburt zu und sind Inhalt seiner Würde und Freiheit.

    3. Die Gleichheit aller Menschen unabhängig von sozialem Status, Beruf, Geschlecht, ethnischer Zugehörigkeit, Hautfarbe, Religion oder politische Meinung. Die Gleichheit vor dem Gesetz, die soziale, wirtschaftlich, kulturelle, zivile und politische Gleichheit muss gewährleistet sein.

    4. Das Prinzip der Republik (res publica versus res privata) muß gewährleisten sein, und zwar dadurch, dass die Einrichtigungen der Herrschaft dem chinesischen Grundsatz der „ fairen Gleichbehandlung von allen Dingen unter dem Himmel“ (Tien Ta) entspricht. Demokratische Selbstregierung verschiedener Gruppen und gesellschaftlicher Zusammenschlüsse von Menschen verschiedener Kultur und verschiedener Glaubensrichtungen müssen möglich sein.

    5. Demokratie. Sie beginnt mit der Abhängigkeit der Regierungsmacht vom Volkswillen, der durch freie Wahlen festgestellt wird. Jeder Amtsträger ist nur auf Zeit gewählt und darf nur durch periodisch wiederholte Wahlen  ins Amt gebracht werden. Das Mehrheitsprinzip findet seine Schranken bei den Minderheitsrechten. Kurz gesagt, die Herrschaft die aus der Demokratie hervor- geht, entsteht aus der dreifachen Bindung der Herrschaft des Volkes, durch das Volk und für das Volk. (Gettisburgh Address, Abraham Lincoln: „Government of the people, by the people and for the people.“ )

    6. Der Verfassungsrechtsstaat. Er kommt zustande durch ein System von Rechtsvorschriften durch das diese Prinzipien (1. bis 6.) zum Schutz der Bürgerrechte, zur Begrenzung der Macht von Institutionen und zur  Bereitstellung öffentlicher Verwaltungseinrichtungen gewährleistet werden.

    Rule by Law instrumentell als geschriebenes Machtmittel verstanden, bleibt weit hinter dem an diese Prinzipien gebundenem Rule of Law zurück. Die Charta 08 bringt die19 Reformprojekt  in die Verfassungsdiskussion ein, durch die die chinesische Verfassungsdiskussion sich an dem Verfassungsdiskurs der Menschheit beteiligt. Alle 6 Prinzipien und auch alle 19 Reformvorschläge liegen sozusagen auf der Hand. Als strukturell, d.h. als im Hintergrund wirkende Faktoren müssen sie aber immer wieder in die Öffentlichkeit gebracht werden.

    Die 19 Reformprojekte  waren vor 18 Jahren für China  von aktueller Bedeutung. Heute sind andere Probleme drängender. Die Frage der Unabhängigkeit Taiwans, die föderale Struktur des ganzen chinesischen Herrschaftsbereichs, der Umweltschutz, die Internatioanlen Beziehungen Chinas zu den USA, zu Japan und zur EU. Die Fragen parakolonialer Anhängigkeiten afrikanischer und südamerikanischer Länder von China.

    Ich will heute nur vier besondere autokratische und monokratische Verfassungsdefizite erwähnen, die nach den Motiven LiuXiaobos, die er   –  mit anderen Autoren   – in die Charter 0ß einfliessen ließ, am heutigen Gedenktag und am Tag der ersten Preisverleihung des LiuXiaobo Preises.

    1. Das System des Bürgersozialkredits, nachdem Menschen durch digital festgestellte Leistungspunkte unterschiedlichen Zugang zu öffentlichen Leistungen haben. Das verstößt eklatant gegen das Prinzip der Gleichheit aller Menschen.

    2. Die Ausdehnung der Amtsdauer des Vorsitzenden der CCP auf dessen Lebenszeit. Das ist eine hybride Ausweitung des Machtanspruchs einer einzigen Person.

    3. Die Verfolgung von strafrechtlich relevanten Tatsachen in der ganzen Welt, die nur in China nach dem uninspirieten chinesischen Recht gelten. Das verstößt gegen den Respekt anderer souveräner Staaten.

    4. In Taipeh wurde der Weg aus der Diktatur zum demokratischen Verfassungsstaat mutig beschritten. Die Einnahme des Sitzes im UN Sicherheitsrat 1971 ohne die Übernahme der Inhalte der UN Charta blieb deshalb eine Scheinmitgliedschaft in der Völkergemeinschaft. Sie stellt einen weiteren Angriff auf die Verfassung der Völkergemeinschaft dar.

    Diese Angriffe stellen eine Praxis dar, die gegen das „Gespräch der Menschheit“ über die Fragen einer guten Verfassung für die Menschheit gerichtet sind. Die Angriffe zeigen, dass wir heute  – angeblich  – in einer Zeit ohne Moral und ohne vernünftigen Verstand leben. Sollte Taiwan in den chinesischen Einparteienstaat eingegliedert werden, so wäre das eine weitere Aufkündigung der Bewegung, die Liu Xiaobo mit der Charta 08 so bedeutsam unterstützte.
